Honest Water Care Plan Membership Terms

Important Membership Summary

Honest Water Care Plans begin with a 12-month initial commitment billed monthly. After the initial term, the membership automatically continues month-to-month until canceled.

Cancellation may be requested by calling 678-403-6551 or emailing hello@honestwaterga.com.

Monitoring equipment remains the property of Honest Water and must be made available for removal after cancellation. Honest Water removes the equipment at no charge. Failure to return the equipment or provide reasonable access for its removal may result in a non-refundable $200 equipment non-return charge.

This summary does not replace the complete Terms below.

These Honest Water Care Plan Membership Terms, referred to as the "Terms," govern participation in the Smart Monitoring, Salt Concierge, and Total Water Care membership plans offered by Honest Water LLC, doing business as Honest Water of Georgia, referred to as "Honest Water," "we," "us," or "our."

The customer enrolling in a Care Plan is referred to as the "Member," "you," or "your."

By selecting a Care Plan, signing or electronically accepting an enrollment agreement, authorizing recurring payments, or using membership benefits, you acknowledge that you have reviewed and agree to these Terms.

1. Important Membership Disclosures

Please review the following before enrolling:

  • Every Care Plan begins with a 12-month initial commitment.
  • Membership fees are billed monthly.
  • After the initial 12-month term, the membership automatically continues month-to-month until canceled.
  • Cancellation may be requested by telephone or email.
  • Monthly payments already processed are generally non-refundable.
  • Benefits are available only while the account is active and current.
  • Monitoring equipment remains the property of Honest Water.
  • Honest Water will remove its monitoring equipment at no charge following cancellation.
  • Failure to return the monitoring equipment or provide reasonable access for removal may result in a non-refundable $200 equipment non-return charge.
  • Total Water Care's no-trip-charge benefit waives the standard dispatch or trip charge. It does not automatically include all repair labor, replacement parts, replacement media, or unrelated plumbing work.
  • Salt benefits are limited to the enrolled residence and qualifying Honest Water system.

2. Membership Eligibility

Care Plans are available for qualifying residential water-treatment equipment installed or approved by Honest Water.

Each membership:

  • Applies to one qualifying residential water-treatment system;
  • Applies only to the enrolled service address;
  • Is intended for ordinary residential use;
  • Requires an active and valid payment method;
  • Requires the account to remain current;
  • Is subject to Honest Water's current service area and operational availability; and
  • Is not transferable except as expressly permitted by these Terms.

Honest Water may inspect or evaluate equipment before approving enrollment, particularly when the equipment was not recently installed by Honest Water.

Honest Water may decline enrollment when equipment, property access, location, plumbing conditions, safety conditions, or unusually high anticipated usage make the requested plan impractical.

3. Available Care Plans

3.1 Smart Monitoring - $14.99 Per Month

Smart Monitoring is designed for Members who will purchase and load their own salt but want Honest Water to monitor usage and tell them what to do and when to do it.

Smart Monitoring includes:

  • Remote salt-level monitoring through qualifying installed monitoring equipment;
  • Proactive low-salt notifications;
  • Guidance regarding the appropriate type of salt;
  • Guidance regarding when salt should be added;
  • Guidance regarding the approximate quantity of salt to add;
  • Routine tankless reverse-osmosis filter replacement reminders;
  • Routine system-maintenance reminders;
  • Remote support for basic system questions;
  • Ten percent off eligible standard non-warranty service labor; and
  • Two standard 40-pound bags of salt provided at the original Honest Water system installation when enrollment is completed before the installation is finished.

Smart Monitoring does not include:

  • Future salt after installation;
  • Salt delivery;
  • Carrying or loading salt;
  • Trip or dispatch charges;
  • Free repair labor;
  • Free replacement parts;
  • Reverse-osmosis replacement filters;
  • Onsite reverse-osmosis filter replacement;
  • Replacement resin, carbon, membranes, media, or other consumables; or
  • Unrelated household plumbing services.

The Member is responsible for purchasing, transporting, and loading all future salt.

3.2 Salt Concierge - $39.99 Per Month

Salt Concierge includes all applicable Smart Monitoring benefits, plus:

  • Up to twelve standard 40-pound bags of salt per Membership Year;
  • Salt replenishment based on available monitoring information and reasonably anticipated usage;
  • Route-based salt delivery;
  • Carrying the salt to the enrolled softener;
  • Loading the salt into the brine tank;
  • No separate standard salt-delivery charge; and
  • Four standard 40-pound bags loaded during the original Honest Water system installation when enrollment is completed before installation is finished.

The four installation bags count toward the twelve-bag allowance for the first Membership Year.

Salt Concierge does not include:

  • More than twelve bags during a Membership Year;
  • Unused bags delivered solely to exhaust an annual allowance;
  • Tankless reverse-osmosis replacement filters;
  • Reverse-osmosis filter replacement labor;
  • Waived trip or dispatch charges;
  • Free non-warranty repairs;
  • Free replacement parts;
  • Replacement resin, carbon, membranes, media, or other consumables; or
  • Unrelated household plumbing services.

If more than twelve bags are reasonably required during a Membership Year, additional salt may be purchased at Honest Water's then-current member price, or the Member may request an upgrade to Total Water Care.

3.3 Total Water Care - $74.99 Per Month

Total Water Care includes all applicable Smart Monitoring and Salt Concierge benefits, plus:

  • Unlimited salt reasonably required for normal residential operation of the enrolled Honest Water softener;
  • Salt delivery, carrying, and loading based on monitored and reasonably anticipated usage;
  • Five standard 40-pound bags loaded during the original Honest Water system installation when enrollment is completed before installation is finished;
  • One standard annual tankless reverse-osmosis filter replacement service;
  • The qualifying standard annual tankless reverse-osmosis replacement filter kit supplied by Honest Water;
  • Standard labor to replace the included annual tankless reverse-osmosis filters;
  • No standard trip or dispatch charge for eligible visits involving the enrolled Honest Water-installed equipment;
  • Priority scheduling when reasonably available;
  • One annual system health check; and
  • One annual basic water test.

Total Water Care does not provide unlimited repairs, unlimited replacement parts, unlimited labor, unrelated plumbing work, replacement water-treatment media, emergency response, or any service specifically excluded by these Terms.

4. Installation Salt Benefits

Installation salt benefits apply only when:

  • The qualifying water-treatment system is being installed by Honest Water;
  • The selected Care Plan is accepted before the original installation is completed;
  • The Member has provided valid recurring-payment authorization; and
  • The membership enrollment has been approved.

Installation salt benefits are not retroactive.

Installation salt cannot be exchanged for:

  • Cash;
  • Account credit;
  • Another product;
  • A later standalone delivery; or
  • Salt for another residence or system.

Existing customers enrolling after their original installation do not receive retroactive installation salt unless Honest Water provides a separate written promotion.

5. Initial Term and Automatic Month-to-Month Renewal

Each Care Plan has an initial term of twelve consecutive months beginning on the membership activation date.

The initial term is billed in monthly installments.

After the initial twelve-month term, the membership automatically continues on a month-to-month basis unless canceled by the Member or Honest Water.

The month-to-month renewal continues at the then-current membership rate until properly canceled.

By enrolling, the Member authorizes Honest Water and its payment processor to charge the selected payment method for:

  • The applicable monthly membership fee;
  • Applicable taxes;
  • Properly assessed equipment charges;
  • Separately authorized products or services; and
  • Other charges expressly permitted under these Terms.

6. Monthly Billing

Membership fees will generally be charged on or near the same calendar date each month as the original activation date.

The Member is responsible for maintaining:

  • An accurate billing address;
  • A valid payment method;
  • An accurate email address;
  • An accurate mobile telephone number; and
  • Current account information.

Honest Water may use one or more third-party payment processors.

Honest Water does not necessarily receive or store the Member's complete payment-card information.

There are no partial-month refunds or prorated membership refunds except where required by law or approved by Honest Water in writing.

7. Failed Payments and Account Suspension

If a payment is declined, reversed, disputed, or remains unpaid, Honest Water may:

  • Retry the payment;
  • Contact the Member for updated billing information;
  • Temporarily suspend monitoring notifications;
  • Suspend salt deliveries;
  • Suspend filter-replacement eligibility;
  • Suspend member discounts;
  • Suspend priority scheduling;
  • Suspend no-trip-charge benefits;
  • Postpone scheduled services;
  • Assess any lawful returned-payment charge disclosed to the Member; or
  • Cancel the membership for continued nonpayment.

Benefits are available only while the account is active and current.

Suspension or cancellation for nonpayment does not eliminate valid amounts already due during the initial twelve-month commitment.

8. Membership Year and Annual Benefits

A "Membership Year" means each consecutive twelve-month period beginning on the membership activation date or an anniversary of that date.

Annual benefits:

  • Reset at the beginning of each Membership Year;
  • Do not roll over;
  • Have no cash value;
  • Cannot be exchanged for another benefit;
  • Cannot be transferred to another property;
  • Cannot be transferred to another customer except through an approved membership transfer;
  • Must be used while the membership is active and current; and
  • May be coordinated with other scheduled service or delivery visits.

The fact that an annual benefit was not used does not create a refund, credit, extension, or reduction in future membership charges.

9. Cancellation During the Initial Twelve-Month Term

A Member may submit a cancellation request at any time.

Unless otherwise required by law or approved by Honest Water in writing, a cancellation request received during the initial twelve-month term:

  • Prevents the membership from renewing after the initial term;
  • Does not eliminate monthly payments remaining in the initial term;
  • Does not create a refund for membership payments already processed;
  • Does not create a refund or credit for benefits already provided;
  • Does not release the Member from properly assessed charges; and
  • Does not eliminate the requirement to return Honest Water's monitoring equipment.

Membership benefits may continue through the end of the paid initial term while the account remains active and current.

Honest Water may approve early termination due to circumstances that include:

  • Permanent relocation outside Honest Water's service area;
  • Sale of the enrolled residence;
  • Removal of the enrolled water-treatment system;
  • Death of the account holder;
  • Documented financial hardship;
  • Property damage that makes continued service impractical; or
  • Other circumstances approved by Honest Water in writing.

Unless applicable law requires otherwise, approval of early termination is at Honest Water's reasonable discretion.

10. Cancellation After the Initial Term

After the initial twelve-month term, the membership continues month-to-month.

A cancellation request received after the initial term becomes effective at the end of the Member's current paid monthly billing period.

Honest Water will not process an additional monthly renewal charge after the effective cancellation date.

Monthly payments already processed are not prorated or refunded except where required by law.

Membership benefits remain available through the effective cancellation date while the account remains active and current.

11. How to Request Cancellation

The Member may request cancellation through either of the following methods:

An email cancellation request may be sent directly or through the preformatted cancellation-email button provided on Honest Water's website.

The request should include:

  • Member's full name;
  • Enrolled service address;
  • Mobile telephone number;
  • Email address; and
  • Requested cancellation date.

Honest Water may request reasonable information to verify that the request was submitted by the Member or an authorized account holder.

The Member is not required to provide a reason for cancellation.

The cancellation request is not invalid merely because monitoring equipment has not yet been removed. Equipment removal and return are separate continuing obligations governed by these Terms.

12. Legally Required Cancellation Rights

Nothing in these Terms limits any cancellation or refund right provided by applicable law.

Certain transactions entered into through face-to-face contact at the Member's residence or away from Honest Water's regular place of business may qualify for a statutory cancellation period.

When applicable, Honest Water will provide any legally required Notice of Cancellation, disclosures, forms, refunds, and equipment-retrieval procedures.

When a Member properly exercises a statutory cancellation right:

  • The Member must make Honest Water's equipment reasonably available for retrieval;
  • Honest Water will be responsible for retrieval expenses as required by law;
  • The $200 equipment non-return charge will not apply when the Member has made the equipment reasonably available;
  • Refund and retrieval timing will be governed by applicable law; and
  • These Terms will not be interpreted to reduce the Member's statutory rights.

13. Monitoring Equipment Ownership

All monitoring sensors, communication equipment, mounting hardware, adapters, and related monitoring devices supplied through a Care Plan remain the exclusive property of Honest Water.

Membership payments do not transfer ownership of the monitoring equipment to the Member.

The Member may not:

  • Sell the equipment;
  • Give it to another person;
  • Transfer it to another residence;
  • Dispose of it;
  • Permanently remove it;
  • Alter it;
  • Tamper with it;
  • Cover, obstruct, or intentionally interfere with it;
  • Attempt to reprogram it; or
  • Allow an unauthorized third party to remove or modify it.

14. Equipment Removal After Cancellation

Following the effective cancellation, expiration, or nonrenewal of a membership, Honest Water will contact the Member to arrange removal and retrieval of the monitoring equipment.

Honest Water will remove the equipment at no charge when:

  • The equipment remains installed or otherwise available;
  • The Member provides safe and reasonable access;
  • The Member reasonably cooperates with scheduling; and
  • Removal can be completed during Honest Water's normal service operations.

Equipment removal may occur shortly before or after the final membership date based on scheduling and operational availability.

The Member must provide reasonable access to the equipment within thirty calendar days after:

  • The effective membership end date; or
  • Honest Water's first documented request to retrieve the equipment,

whichever occurs later.

Honest Water may remove monitoring equipment before the end of the initial term when an early cancellation is approved or when continued monitoring is no longer practical.

15. $200 Equipment Non-Return Charge

Honest Water may charge a non-refundable $200 equipment non-return charge if the Member:

  • Refuses to make the equipment available for retrieval;
  • Fails to provide reasonable access within the required timeframe;
  • Repeatedly misses or prevents scheduled removal appointments;
  • Removes the equipment without Honest Water's authorization;
  • Loses the equipment;
  • Sells or transfers the equipment;
  • Discards or destroys the equipment;
  • Cannot return the equipment; or
  • Returns the equipment materially damaged beyond ordinary wear and tear.

Before assessing the charge solely because of access or scheduling failure, Honest Water will make reasonable efforts to contact the Member and offer at least two reasonable removal appointment opportunities.

The charge is an equipment non-return charge and is not a cancellation fee.

The charge will not apply when:

  • The equipment remains available for removal;
  • The Member has provided reasonable access;
  • The Member has provided reasonable scheduling opportunities; and
  • Honest Water fails to retrieve the equipment through no fault of the Member.

Once properly assessed, the equipment non-return charge is non-refundable unless Honest Water voluntarily agrees otherwise or a refund is required by law.

Payment of the equipment non-return charge does not transfer legal ownership of recoverable Honest Water equipment unless Honest Water expressly agrees in writing.

16. Equipment Damage

The Member is not responsible for ordinary wear and tear or equipment failure caused by ordinary operation.

The Member may be responsible for loss or damage caused by:

  • Intentional conduct;
  • Unauthorized removal;
  • Tampering;
  • Abuse;
  • Negligence;
  • Disposal;
  • Improper storage;
  • Failure to protect the equipment during construction or renovation;
  • Damage caused by an unauthorized technician;
  • Transfer to another person or property; or
  • Failure to follow reasonable protection instructions.

Honest Water may waive an equipment charge when the failure or damage resulted from ordinary use, product failure, or circumstances not reasonably caused by the Member.

17. Remote Monitoring

Remote monitoring depends on the proper operation of:

  • The installed monitoring sensor;
  • Available power or battery capacity;
  • Internet, Wi-Fi, cellular, Bluetooth, or other applicable connectivity;
  • Third-party monitoring software or platforms;
  • Proper sensor placement;
  • Accurate setup;
  • The Member's contact information; and
  • The Member not disconnecting, moving, damaging, or obstructing the equipment.

The Member authorizes Honest Water to access and use equipment data reasonably necessary to provide monitoring and membership services.

"24/7 monitoring" means that the monitoring equipment is intended to collect or transmit salt-level information continuously when functioning and connected.

It does not mean that an Honest Water employee personally observes the account every second of every day.

Monitoring is not:

  • An emergency-response service;
  • A security service;
  • A life-safety service;
  • A guaranteed leak-detection service;
  • A guarantee that the system will never run out of salt;
  • A guarantee that every system issue will be detected remotely; or
  • A substitute for reasonable observation by the homeowner.

Honest Water is not responsible for a missed or delayed alert caused by:

  • Connectivity failure;
  • Power loss;
  • Sensor malfunction;
  • Platform outage;
  • Inaccurate readings;
  • Customer interference;
  • Incorrect contact information;
  • Force majeure; or
  • Circumstances outside Honest Water's reasonable control.

The Member should promptly contact Honest Water if salt usage appears abnormal, the monitor appears disconnected, or the system appears to be malfunctioning.

18. Salt Products

Honest Water will select the standard water-softener salt used to fulfill membership benefits.

Unless otherwise approved in writing, included salt consists of standard 40-pound bags of softener salt selected by Honest Water.

Membership does not entitle the Member to:

  • A specific retail brand;
  • Potassium chloride;
  • Specialty salt;
  • Premium retail packaging;
  • Delivery of unused salt for storage;
  • Stockpiling;
  • Resale;
  • Transfer to another system;
  • Transfer to another property; or
  • Cash in place of salt.

Specialty salt or potassium chloride may be available for an additional charge.

19. Salt Delivery and Loading

Salt delivery is provided through Honest Water's route-based operations.

Honest Water determines:

  • When salt is reasonably needed;
  • The quantity to be delivered;
  • The delivery date and route;
  • Whether monitoring information should be verified;
  • Whether a delivery can be combined with another scheduled service;
  • Whether property access is required; and
  • Whether unusual consumption requires inspection.

Salt delivery is not an emergency or guaranteed same-day service.

Honest Water will use commercially reasonable efforts to replenish salt before depletion based on:

  • Available monitoring data;
  • Route availability;
  • Staffing;
  • Product availability;
  • Property access;
  • Weather;
  • Traffic;
  • Safety conditions; and
  • Other operating conditions.

The Member must provide:

  • Safe and reasonable property access;
  • Safe access to the softener and brine tank;
  • Accurate gate, alarm, and entry information;
  • A reasonably clear path for carrying 40-pound bags;
  • Notice of aggressive animals or other hazards; and
  • Any presence or authorization reasonably required for interior access.

Honest Water may postpone or decline delivery when access is unavailable or unsafe.

20. Salt Concierge Annual Allowance

Salt Concierge includes up to twelve standard 40-pound bags during each Membership Year.

The annual allowance includes any plan-specific salt provided during installation in that Membership Year.

Unused bags:

  • Do not roll over;
  • Have no cash value;
  • Cannot be exchanged for account credit;
  • Cannot be transferred;
  • Cannot be delivered merely to exhaust the annual allowance; and
  • Cannot be used at another property.

Honest Water determines delivery timing and quantity according to monitored or reasonably anticipated need.

The Member is not entitled to receive the entire annual allowance at once.

Additional salt may be purchased at Honest Water's then-current member price after the annual allowance has been exhausted.

21. Unlimited Salt Under Total Water Care

"Unlimited salt" means the amount of standard salt reasonably necessary for normal residential operation of the enrolled Honest Water system.

Normal residential use generally assumes:

  • One enrolled residence;
  • Ordinary household occupancy;
  • Ordinary household water consumption;
  • Properly functioning plumbing;
  • Properly functioning water-treatment equipment;
  • Honest Water-approved settings;
  • No commercial use;
  • No resale;
  • No stockpiling; and
  • No use for another property or system.

Unlimited salt does not include abnormal usage caused by:

  • Plumbing leaks;
  • Running toilets;
  • Continuously running fixtures;
  • Excessive irrigation;
  • Pool filling;
  • Commercial or business activity;
  • Unusually high temporary occupancy;
  • Unauthorized programming changes;
  • Equipment misuse;
  • System damage;
  • Third-party modifications;
  • Failure to complete a recommended repair;
  • Salt being transferred elsewhere;
  • Salt being resold; or
  • Any condition that causes unreasonable or avoidable salt consumption.

If salt consumption is materially higher than expected, Honest Water may:

  • Review monitoring records;
  • Request information;
  • Inspect the plumbing or equipment;
  • Adjust settings;
  • Recommend repair;
  • Temporarily suspend unlimited salt fulfillment until an abnormal condition is corrected; or
  • Charge for salt attributable to excluded abnormal use.

Honest Water will not unreasonably withhold salt needed for ordinary operation of a properly functioning enrolled system.

22. Tankless Reverse-Osmosis Filter Replacement

Total Water Care includes one standard annual tankless reverse-osmosis filter replacement service for a qualifying tankless reverse-osmosis system installed or approved by Honest Water.

The benefit includes:

  • The standard annual filter kit designated by Honest Water for the qualifying system;
  • Standard onsite labor to remove and replace the included filters; and
  • Basic operational verification after replacement.

The first included annual replacement becomes available:

  • At the equipment's normal annual replacement interval;
  • No earlier than ten consecutive paid months following installation or the previous standard filter replacement;
  • While the Total Water Care membership is active and current; and
  • Subject to normal scheduling and access requirements.

Unless specifically identified as part of the standard annual filter kit, the benefit does not include:

  • Reverse-osmosis membranes;
  • Mineral cartridges;
  • Alkaline cartridges;
  • Specialty cartridges;
  • Optional upgrade filters;
  • Damaged filter housings;
  • Faucets;
  • Tanks;
  • Pumps;
  • Electronic components;
  • Plumbing modifications;
  • Freeze damage;
  • Flood damage;
  • Customer-caused damage;
  • Repairs;
  • Contamination remediation; or
  • Filters for equipment not installed or approved by Honest Water.

Honest Water may combine annual filter replacement with:

  • A salt delivery;
  • A system health check;
  • A water test; or
  • Another scheduled service visit.

Members who do not have a qualifying tankless reverse-osmosis system do not receive cash, credit, substitute equipment, or an alternative benefit unless Honest Water agrees otherwise in writing.

23. No-Trip-Charge Benefit

Total Water Care waives Honest Water's standard trip or dispatch charge for eligible visits involving the enrolled Honest Water-installed equipment.

The no-trip-charge benefit covers the normal charge for dispatching an Honest Water representative to the enrolled service address during Honest Water's normal service operations.

It does not automatically include:

  • Repair labor;
  • Replacement parts;
  • Replacement resin;
  • Replacement carbon;
  • Replacement media;
  • Reverse-osmosis membranes;
  • Electrical work;
  • Drain work;
  • Permit fees;
  • Household plumbing;
  • Third-party equipment;
  • Emergency service premiums;
  • After-hours service premiums;
  • Damage caused by freezing;
  • Flood damage;
  • Damage caused by misuse;
  • Damage caused by neglect; or
  • Damage caused by unauthorized modification.

Warranty-covered parts and labor remain governed by the applicable written Honest Water warranty.

Non-warranty work may be separately quoted and charged.

The no-trip-charge benefit applies only when Honest Water reasonably determines that the visit relates to the enrolled Honest Water-installed equipment.

Honest Water may charge its normal rates for:

  • Unrelated household plumbing;
  • Work on third-party equipment;
  • Repeat visits caused by refusal to complete a recommended repair;
  • Missed appointments;
  • Unsafe or unavailable access;
  • Customer-caused damage;
  • Abusive or knowingly false service requests;
  • Work outside Honest Water's normal service area;
  • After-hours service;
  • Emergency service; or
  • Work expressly excluded from the plan.

24. Service-Labor Discount

Smart Monitoring and Salt Concierge Members receive ten percent off eligible standard non-warranty service labor performed by Honest Water.

The discount does not apply to:

  • Trip or dispatch charges;
  • Parts;
  • Equipment;
  • Salt;
  • Filters;
  • Replacement media;
  • Resin;
  • Carbon;
  • Permits;
  • Taxes;
  • Financing charges;
  • Third-party services;
  • Previously completed work; or
  • Services already subject to another discount or promotion.

Discounts may not be combined unless Honest Water approves the combination in writing.

25. Annual System Health Check and Basic Water Test

Total Water Care includes one annual system health check and one annual basic water test.

These services may include:

  • A visual equipment inspection;
  • Review of control settings;
  • General operational verification;
  • Review of monitoring information;
  • Basic onsite water testing selected by Honest Water; and
  • Identification of visible or reasonably apparent maintenance concerns.

These services are not:

  • A plumbing-code inspection;
  • A comprehensive home inspection;
  • A laboratory analysis;
  • A guarantee that water is free of all contaminants;
  • A medical or health certification;
  • A guarantee of equipment performance;
  • A certification that water is suitable for every purpose; or
  • A substitute for specialized testing by a certified laboratory.

Additional laboratory testing may be offered for a separate charge.

26. Scheduling and Property Access

Deliveries and appointments are subject to:

  • Technician availability;
  • Route availability;
  • Weather;
  • Traffic;
  • Product availability;
  • Equipment availability;
  • Safe property access;
  • Customer availability when interior access is required; and
  • Circumstances outside Honest Water's reasonable control.

Appointment windows are estimates and are not guaranteed arrival times.

The Member must disclose:

  • Aggressive animals;
  • Locked gates;
  • Alarm requirements;
  • Restricted access;
  • Construction hazards;
  • Unsafe flooring;
  • Flooding;
  • Electrical hazards; or
  • Any other known condition that may affect safe access.

Honest Water may charge a reasonable missed-appointment charge if a confirmed visit cannot be completed because the Member failed to provide required access or reasonable advance notice.

27. Parts, Labor, Repairs, and Existing Warranties

Care Plans do not replace, extend, or expand Honest Water's written equipment or installation warranties unless expressly stated in writing.

Parts and labor are included only when:

  • Covered by an applicable warranty;
  • Specifically included in the selected Care Plan; or
  • Separately purchased or authorized.

Membership does not create:

  • A comprehensive repair contract;
  • An unlimited labor agreement;
  • An unlimited parts agreement;
  • A whole-house plumbing warranty; or
  • A lifetime warranty beyond applicable written warranty terms.

Honest Water may recommend repairs or replacement necessary for safe or continued operation.

Refusal to complete a necessary repair may affect:

  • Monitoring accuracy;
  • Salt consumption;
  • Salt eligibility;
  • No-trip-charge eligibility;
  • Filter service;
  • System operation; or
  • Continued membership eligibility.

28. Member Responsibilities

The Member agrees to:

  • Maintain accurate contact information;
  • Maintain a valid payment method;
  • Maintain any required internet, power, or connectivity;
  • Protect monitoring equipment;
  • Notify Honest Water of unusual system behavior;
  • Correct known leaks and running fixtures;
  • Follow reasonable equipment-care instructions;
  • Avoid unauthorized modifications;
  • Provide safe property access;
  • Use included products only at the enrolled residence;
  • Avoid transferring or reselling salt;
  • Notify Honest Water before selling or vacating the property; and
  • Cooperate with equipment retrieval after cancellation.

29. Moving or Selling the Residence

The membership applies to the enrolled service address and does not automatically follow the Member to another residence.

If the residence is sold or transferred, the Member must contact Honest Water before closing or vacating the property.

The Member may request:

  1. Removal and return of the monitoring equipment; or
  2. Transfer of the membership and monitoring equipment to the new homeowner.

A transfer requires:

  • Honest Water's approval;
  • Acceptance of the then-current membership terms by the new homeowner;
  • Valid payment authorization from the new homeowner;
  • Confirmation of equipment eligibility; and
  • Confirmation of the effective transfer date.

The original Member remains responsible for charges and obligations incurred before the transfer becomes effective.

A transfer does not automatically reset:

  • Salt allowances;
  • Annual filter eligibility;
  • Annual service benefits;
  • Membership-Year dates; or
  • Benefits already used.

30. Plan Upgrades and Downgrades

Members may request an upgrade at any time.

An upgrade may require:

  • A new twelve-month initial term;
  • A prorated charge;
  • Updated payment authorization;
  • Verification of qualifying equipment;
  • A property or equipment inspection; or
  • Payment of any applicable plan difference.

Benefits already used during the current Membership Year count toward benefits available under the upgraded plan.

Downgrades generally become effective at the end of the current initial term or Membership Year.

Honest Water may decline an immediate downgrade when annual salt, filter, service, or other benefits have already been provided.

31. Price and Term Changes

Honest Water may change future membership prices, benefits, or Terms by providing advance notice as required by law.

Unless otherwise required by law:

  • A price increase will not apply retroactively;
  • A price increase during the initial twelve-month term will take effect after the initial term;
  • A price increase during month-to-month renewal will take effect after at least thirty days' notice; and
  • A material change will include information regarding how the Member may cancel future renewal.

Continued membership after the effective date of a properly disclosed change constitutes acceptance of the updated terms, except where additional consent is legally required.

32. Honest Water's Right to Suspend or Cancel Membership

Honest Water may suspend or cancel a membership because of:

  • Nonpayment;
  • Fraud;
  • Abuse of benefits;
  • Unsafe property conditions;
  • Commercial use;
  • Resale or diversion of salt;
  • Repeated denial of access;
  • Unauthorized equipment modification;
  • Equipment tampering;
  • Harassment or threatening conduct;
  • Material violation of these Terms;
  • Relocation outside the service area;
  • Equipment that no longer qualifies;
  • Refusal to correct abnormal salt consumption;
  • Repeated missed appointments; or
  • Circumstances that make continued service impractical or unsafe.

If Honest Water cancels without Member breach, Honest Water will stop future recurring charges and provide any refund required by law.

Cancellation by Honest Water does not eliminate the Member's obligation to return monitoring equipment.

33. Events Beyond Honest Water's Control

Honest Water is not responsible for delays or interruption caused by circumstances outside its reasonable control, including:

  • Severe weather;
  • Natural disaster;
  • Road closure;
  • Vehicle failure;
  • Product shortage;
  • Labor shortage;
  • Utility outage;
  • Internet outage;
  • Monitoring-platform outage;
  • Government action;
  • Public emergency;
  • Supply-chain interruption;
  • Unsafe property conditions; or
  • Similar events.

Honest Water will use commercially reasonable efforts to resume affected service when reasonably possible.

34. No Emergency or Life-Safety Service

Care Plans are not emergency-response services.

Members experiencing:

  • Active flooding;
  • A major plumbing leak;
  • Electrical danger;
  • Sewage backup;
  • Suspected unsafe drinking water;
  • Fire;
  • Medical emergency; or
  • Another immediate danger

should contact an appropriate emergency service, licensed professional, utility, or government authority.

Honest Water does not guarantee emergency, same-day, after-hours, or immediate response.

35. Disclaimer of Guarantees

Honest Water will provide membership services using commercially reasonable care.

Honest Water does not guarantee:

  • Uninterrupted remote monitoring;
  • Detection of every condition;
  • Same-day salt delivery;
  • Same-day technician service;
  • That the system will never run out of salt;
  • That the equipment will never require repair;
  • That water conditions will remain unchanged;
  • Removal of every contaminant;
  • Performance of third-party products;
  • Performance of third-party networks; or
  • Results beyond applicable written equipment specifications or warranties.

Nothing in these Terms eliminates a valid written warranty separately provided by Honest Water.

36. Limitation of Liability

To the maximum extent permitted by applicable law, Honest Water will not be responsible for indirect, incidental, special, punitive, exemplary, or consequential damages arising from:

  • A missed or delayed monitoring alert;
  • Temporary monitoring interruption;
  • Delayed delivery;
  • Delayed service;
  • Equipment failure;
  • Loss of connectivity;
  • Member failure to follow instructions;
  • Plumbing leaks;
  • Abnormal water consumption;
  • Third-party products;
  • Third-party platforms; or
  • Circumstances outside Honest Water's reasonable control.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

37. Privacy and Equipment Data

The Member authorizes Honest Water to collect, store, access, and use information reasonably necessary to administer the Care Plan, including:

  • Contact information;
  • Service address;
  • Equipment information;
  • Salt-level information;
  • Monitoring data;
  • Service history;
  • Delivery history;
  • Payment status;
  • Account communications; and
  • Customer preferences.

Information may be shared with service providers reasonably necessary to provide:

  • Payment processing;
  • Monitoring;
  • Scheduling;
  • Communications;
  • Customer support;
  • Delivery; or
  • Technical services.

Honest Water will not sell monitoring data as a standalone commercial product to unrelated third parties.

38. Electronic Communications

The Member agrees to receive membership-related communications through:

  • Email;
  • Text message;
  • Telephone;
  • Application notification; or
  • Other electronic methods selected during enrollment.

Membership-related communications may include:

  • Salt alerts;
  • Maintenance reminders;
  • Appointment notices;
  • Payment notices;
  • Failed-payment notices;
  • Automatic-renewal disclosures;
  • Cancellation confirmations;
  • Equipment-removal scheduling;
  • Service updates;
  • Benefit notices; and
  • Changes to these Terms.

Consent to receive marketing messages is separate from consent to receive operational membership communications where required by law.

39. Electronic Acceptance and Recurring-Payment Authorization

Electronic acceptance has the same effect as a handwritten signature to the extent permitted by law.

By enrolling, the Member:

  • Accepts the selected Care Plan;
  • Accepts the applicable monthly price;
  • Accepts the initial twelve-month commitment;
  • Accepts automatic month-to-month renewal after the initial term;
  • Authorizes recurring monthly charges;
  • Acknowledges the cancellation process;
  • Acknowledges Honest Water's ownership of the monitoring equipment;
  • Acknowledges the equipment-return requirement; and
  • Acknowledges the potential $200 equipment non-return charge.

The Member should save or print a copy of these Terms and the enrollment confirmation.

40. Governing Law

These Terms are governed by the laws of the State of Georgia without regard to conflict-of-law principles.

The parties agree to first attempt to resolve disputes through direct, good-faith communication.

Nothing in these Terms prevents either party from pursuing a remedy available under applicable law.

41. Assignment

The Member may not assign or transfer the membership except through an approved property-transfer process.

Honest Water may assign or transfer these Terms to:

  • A successor;
  • An affiliate;
  • A purchaser of substantially all relevant business assets; or
  • Another entity capable of performing the membership obligations.

Any assignment remains subject to applicable law.

42. Entire Agreement

These Terms, the selected plan description, the enrollment confirmation, recurring-payment authorization, applicable written warranties, and any signed addenda constitute the agreement governing the Care Plan.

If general advertising copy conflicts with these Terms, the specific enrollment confirmation and these Terms control, except where prohibited by law.

43. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.

44. No Waiver

Honest Water's failure to enforce a provision on one occasion does not waive the right to enforce that provision later.

A waiver is effective only when provided in writing by an authorized Honest Water representative.

45. Headings

Section headings are provided for convenience and do not change the meaning of these Terms.
